Event Policy
Event Terms and Conditions
For and in consideration of the undersigned (“Participant”) being permitted by the Flexible Packaging Association (“FPA”) to participate as a registered attendee in an FPA sponsored event, Participant acknowledges and agrees as follows:
Assumption of Risk/Compliance Requirements: Participant is aware there are inherent risks that may result from Participant’s participation at the Event, which may include but is not limited to risks of injury or illness. For and in consideration of Participant being permitted by FPA to participate in the Event, Participant agrees to comply with all rules and regulations set forth by FPA and the venue, and Participant agrees to comply with all applicable laws while attending FPA’s event. Although FPA will take reasonable measures to meet Participant’s expectations for the Event, FPA cannot prevent Participant from becoming ill or injured while participating in the Event.
In addition, Participant understands that the Event may be impacted by events beyond FPA’s reasonable control, including earthquake, extreme weather, or other acts of God; labor disputes, strikes; terrorism; any law, order, proclamation, regulation, ordinance, demand, or requirement having legal effect of any regulatory authority or other competent governmental or judicial body, agency, or authority; pandemic or infectious disease; or any other event or cause whatsoever, whether similar or dissimilar to those referred to in this definition, which is beyond FPA’s reasonable control. In the case of any act or cause outside the control of FPA, as set out herein that makes the holding of the event impossible, illegal, impractical or inadvisable, FPA may move or cancel the Event.
Waiver of Liability/Lawsuit: Participant further acknowledges that there may be risks and dangers not known to Participant or FPA or not reasonably foreseeable at this time. Participant acknowledges that there are risks and uncertainties inherent in participating, including but not limited to illness, death and/or damage to person or property due to the negligent acts or omissions of FPA and/or others. Participant acknowledges, understands, and assumes the risks, if any, arising from the conditions and use of any locations for the Event and will waive Releasees from liability for personal injury, property damage, and wrongful death, including if caused by negligence, if any, of Releasees.
''Releasees'' include FPA and its officers, directors, employees, affiliates, partners, event hosts, owners and operators of the premises used to conduct any event and each of them, their officers, directors, agents and employees.
Photo: During the Event, Participant understands that FPA may photograph or record Participant as part of the Event. Participant hereby grants FPA the irrevocable, perpetual, royalty free and unrestricted right and permission to take, use, re-use, publish, and republish videos and photographic portraits or pictures of Participant or in which Participant may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now or hereafter known, specifically including but not limited to print media and video recordings, and distribution over the Internet for illustration, promotion, art, editorial, advertising, trade, or any other purpose. Participant specifically consents to the digital compositing or distortion of the videos, portraits or pictures, including without restriction any changes or alterations as to color, size, shape, perspective, context, foreground or background, provided that such changes do not compromise Participant or otherwise portray Participant in a negative or derogatory manner and such changes shall be made in accordance with applicable laws. Participant waives any right to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with them or the use to which they may be applied.
Conduct: Participant agrees to treat other participants, attendees, and those located at the Event with respect and professionalism. FPA’s intention is to create a collegial, respectful, inclusive, and professional environment at the Event. In addition, to ensure a safe and inclusive environment for all attendees, please be advised that this event is weapons-free, meaning, to the extent allowed by applicable law, no weapons of any kind, including firearms, are permitted on the premises. FPA we reserves the right to adopt any other criteria, standards, or other rules and regulations and FPA reserves the sole discretion in enforcement of these policies.
Other: In the event that Participant files a lawsuit against FPA, Participant agrees to do so solely in the State of Maryland, and Participant further agrees that the substantive law of the State of Maryland shall apply in that action without regard to the conflict of law rules. Each party hereby irrevocably consents to the exclusive jurisdiction and venue of any state or federal court located within the State of Maryland. Notwithstanding any other term of this Agreement, in no event shall any liability of the Releasees exceed the amount actually paid for the Event or One Hundred Dollars ($100), whichever is greater.
