States Regroup on Flexible Packaging Laws

In New York, the debate over extended producer responsibility (EPR) legislation for packaging was the marquee battle again this year. Bills A1749 and S1464 were the vehicles for EPR legislation that would have gone further and been more punitive for all types of packaging than any other EPR laws worldwide. In contrast, more moderate legislation in the form of A6191 and S5062 represented an approach to EPR that was more consistent with laws in other states, including Minnesota and Maryland. In the end, after fierce lobbying between allied industries and environmental groups, a bill did not pass, and the debate will resume in 2027.
